Reacting to an opinion from Attorney General Ken Cuccinelli that holders of concealed-weapon permits may bring their guns into university buildings, Old Dominion University is moving to prohibit them from doing so.
The ODU administration has drafted a regulation for consideration by the university’s governing Board of Visitors at its December meeting that would explicitly ban all guns, except those carried by police officers, from campus buildings and sports events.
In a July opinion requested by a state lawmaker, Cuccinelli said a University of Virginia policy banning guns from campus does not apply to holders of concealed-weapon permits.
ODU has a similar policy, as do most Virginia state colleges and universities.
University policies do not override a concealed-weapon permit holder’s right to carry his or her gun, Cuccinelli said in his opinion.
However, the attorney general left open an avenue for universities to ban those guns if they wish.
They may do so by enacting a regulation – as opposed to a policy – because, he said, regulations have the force of law.
He cited a recent decision of the state Supreme Court upholding such a regulation at George Mason University. ODU is modeling its proposal on that regulation, which reads:
“Possession or carrying of any weapon by any person, except a police officer, is prohibited on university property in academic buildings, administrative office buildings, student residence buildings, dining facilities, or while attending sporting, entertainment or educational events.”
Cuccinelli noted that the U.S. Supreme Court has said the Second Amendment right to bear arms is not unlimited. The high court has said the government may enact “laws forbidding the carrying of firearms in sensitive places such as schools and government buildings.”
The state Supreme Court found that the GMU regulation meets that test.
Cuccinelli suggested, however, that universities can only go so far, pointing out that the state court did not give its blessing to an absolute campus weapons ban.
The court noted that the GMU regulation “is tailored, restricting weapons only in those places where people congregate and are most vulnerable – inside campus buildings and at campus events.” Weapons are still allowed, the court said, “on the open grounds of GMU and in other places on campus not enumerated in the regulation.”
ODU President John Broderick has declared public safety the university’s most pressing issue in the wake of a student’s fatal shooting and a string of robberies in neighborhoods adjoining the campus in recent months.
“The Virginia Supreme Court and Virginia’s attorney general have stated that a university is a ‘sensitive place’ where a person’s Second Amendment rights could be limited,” Jennifer Mullen, an ODU spokeswoman, said by email. “The university is pursuing the proposed regulation to be consistent with what is recommended in both opinions.”
A bill to prohibit such regulations was submitted in the 2011 General Assembly but died in a Senate committee.

Also many are saying that it is hard to fuly restrict on campus due to there being residential dwellings on campus. If the school is serious about sticking to a no gun policy they need to put their money where their mouth is and purchase those dwellings and re-establish new campus and community boundaries. It is counter-productive to enact legislation towards one goal and allow dangerous loopholes to exist.
The ban by the ODU
The ban by the ODU administration is not working. On the first day of school a student was robbed at gun point for their I phone. Unless ODU is willing to set up searches and check points throughout campus TO ENSURE THERE ARE NO GUNS than they are jeopardizing student safety. As a freshman on campus I do not feel safe at school at all. If I saw an armed officer at every avenue on campus and at all hours it would definitely help but as of now it is mostly UN-armed security personnel with radios. Anyone who conceal carry's understands that a firearm is foremost a deterrent to crime for the pure fact that you don't know who is armed and who is not. Also a firearm does not replace the police it only buys you time till they get there.
Fire Arms Ban
The ODU officials are attacking the wrong problem. The problem is criminal attacks using guns and knives against law abiding persons on and near campus. Banning persons from legally possessing the means of self defense will not solve the problem. Before you can solve any problem you must realize what it is. The gun ban against persons legally authorized to have possession shows a complete lack of understanding the real problem. It will only result in more victims easily being found by the criminal element. They are law breakers already, a university rule will only aid them in their criminal behavior.
THREE CHOICES
From what I see, it comes down to there being three solutions to this problem of which only one can be the right answer:
1. Allow the upstanding citizenry to be armed within the law to protect themselves against any serious bodily harm.
2. Emulate East Germany by having armed check points strewn throughout the campus.
3. Leave the problem 'as is' and continue to watch innocent victims being picked off like tin cans on a fence.
ODU firearms ban
ODU's attempt to ban law abiding CCW holders from protecting themselves on the campus is misguided, shortsighted, & reckless. Such bans do nothing to protect law abiding citizens from criminal attacks. "Gun-free zones" are not about public safety but about protecting the financial interests of the university (liability insurance issue). I urge all citizens to fight this ban & defeat it. Our lives & the lives of our fellow citizens are our individual responsibility & not the responsibility of governmental leaders, law enforcement officers, &/or university administrators. We the people are tasked with our own safety. Those that choose not to arm themselves have that right. CCW holders have the right & duty of self-defense.

anti gunners beware
when you disarm us with a CCW and you find yourself getting raped or whatever the case may be and no campus rent a cop to lend a hand, don't expect any help, you made your bed.....enjoy what you reap. I wouldn't help anyone on that campus if I could after reading this. This country sucks more and more! Its okay to drink drive and kill only to get a license back in 6 months or less with a good lawyer, but you can't carry to protect yourself or you do time. The world has its head up its south pole!
BAN COLLEGES
They should ban colleges, if what we get from college educated people are those we eventually elect. Yes, the ones that give hundreds of millions of dollars to terrorists that kill our own people, only to rebuild everything for them and pump more money into their hands to buy more weapons to kill us.......and they worry about us carrying legally in the states. This country amazes me, I suppose college or something in the overly educated mind removes most of one's common sense.
defeating the purpose of protection
When a person abides the law and seeks to protect themselves by going a legal route to do so, a criminal armed could care less what law is passed. All this does is to disarm a person from potentially protecting themselves, while a person intent on doing harm could care less and commit whatever crime all well knowing that they are now much safer to do so. Anti-gun people will never understand this I suppose. The crimes are committed by criminals, not by the law abiding trying to protect themselves.
ODU is becoming
a less desirable school. It is easy to see it is declining. The crime would be enough for me not to let my kids go there.
