Jury calls for 68 years for murder of Va. Beach detective

VIRGINIA BEACH

Jurors on Wednesday recommended a man spend 68 years in prison for the 2008 murder and robbery of a plainclothes police officer during an undercover drug investigation.

Marshall Demetrius Moyd, 30, is the second person to be convicted in the killing of Detective Michael Phillips in the Green Run Square Shopping Center the night of Aug. 7.

Ted Vincent Carter, who opened fire on Phillips as he and Moyd discussed a drug deal inside a pickup, is serving life without parole for capital murder.

Chief Deputy Commonwealth's Attorney Colin Stolle called Moyd the mastermind of the night's events, arguing that both Moyd and Carter set out to rob the detective of the $675 cash he had brought for the marijuana. Moyd's attorney, Andrew Sacks, argued Carter alone decided to rob and kill.

After convicting Moyd on Tuesday, the jury deliberated about six more hours Tuesday afternoon and Wednesday morning before recommending he serve 32 years for murder, 25 years for robbery, and 11 years for three gun-related charges.

Circuit Court Judge Patricia L. West will formally sentence Moyd on Jan. 25.

The family of Phillips, which includes a wife and two young sons, released a statement Wednesday thanking prosecutors and Virginia Beach police for their work. They wrote that they were pleased with the verdict.

"Mike's death will never have closure - as he touched so many lives - but today we have justice," the statement read.

A young cop with a wife and kids lost his life...for what, a plant? It's time we developed a sensible drug policy.

Why bother, kill the man if it is proven 100% he did it. Why pay for this person to live after he killed someone. I'm different than most as I believe in the death penalty if it can be proven 100%. I believe if you murder under law, you should forfeit you life as well, PERIOD. I know some will agree, I'll settle up later when I am dead about my feelings when I was alive.

Justice will never truly come until we stop fighting this "war" against a plant.

This is what is wrong with THUGS...Instead of doing the deal

and being semi honorable law breakers their whole intent was to scam another in a drug deal. Somewhere somehow these 2 young thugs learned that being complete THUGS was better than making a drug deal and making the exchange. Unfortunately for them and now for society we will be paying for them to live out their lives in prison and worst of all a police officer's family and friends will suffer a much greater loss forever.

To the families of the convicted these were not good boys gone bad, you raised the lowest level of sewage society can produce, you completely failed society in teaching your convicted murderers about the value of life.

I will not feel sorry for these thugs when they're in the end stage of life in prison alone.

Did the thugs have any drugs on them to sell to the undercover cop? I read that they knew he was going to have $675.00 on him because that was the deal.........I also heard that these 2 thugs did NOT have any drugs on them to sell.....their premeditated scheme was to rob the person of the $675.00 and it went wrong and they murdered him instead in cold blood.

Hey cuz, now what do you have to say? I hope your family does pursue his case, but it better not be with my hard earned tax money. Enough already has been spent on your cuz....and now I have to foot another 68 years to keep him healthy and alive. I hope he meets his match in prison if you know what I mean...street justice...

Prisons Are Overcrowded

With people who have committed "crimes" with no guns. Depending on their offense how about overcrowding some halfway houses instead of the prisons to lower operating costs on prisons so there is more money to french fry these shooters. Another problem with overcrowding is other states prisoners taking residence in our facilities. We aren't charging them enough.

I'm sorry this officer ever

I'm sorry this officer ever had to get involved in our draconian war on marijuana. That war has dragged this otherwise free country down for fifty years now.

Thought we learned our lesson with prohibition.

Self ED

Everytime the subject of drugs comes up you always call it a war. I can see your point because of the money spent and the lives that have been taken. You always stand behind your beliefs with class. I may not always agree with you because I have been to places where most drugs are legal, to a point. Those countries have a whole set of other problems because of the legality. I say if people want to abuse there bodies with heroin, crack, etc so be it. However, do not cry the blues when if you survive the overdose or commit crimes trying to feed their "hobby". I feel there is no black and white answer, only personal choices.

Perhaps in the past

but the only thing self ed mentioned here was marijuana. Less lethal than alchohol, yet people continue to die over it. Rest assured, nobody is dying of a marijuana overdose. Completely unfair to bring heroin and crack into the same conversation.

Just a thought

I've found in my own personal research that the government does act accordingly to the survival of our nation. What I mean by this is, just about anything that prevents us from moving forward as society is illegal or restricted. Drugs, illegal drugs are illegal because it brings down the country as a whole. No one is overdosing over weed, however, people are dying from it. It is proven that most dumb crap that happens in American daily crime stems from drug and alcohol use. Main reason why DUI is called a DUI and not DUA. Just because one is aware that it does not affect another the same way, doesn't mean it is cool for everyone. When I was in college, people always apologized for something the next day and blamed it on being "HIGH".
