Man pleads guilty to bringing gun to N.C. college campus

ELIZABETH CITY, N.C.

A man arrested after bringing an assault weapon on the Elizabeth City State University campus in November pleaded guilty Monday and got 60 days in jail.

Rashaad Gardner, 25, pleaded guilty in Pasquotank County District Court to misdemeanor charges of bringing a gun on education property and going armed to the terror of the people. He will serve 26 days because he received 34 days of credit for time served, said District Attorney Frank Parrish.

As part of the deal, Gardner - a 2010 ECSU graduate - was ordered not to go to the campus.

On Nov. 5 about 2:30 a.m., campus police were alerted that a man was on campus with an assault weapon. Gardner refused to drop the AK-47 when confronted and aimed toward the officers. He retreated into a woods after the officers shot him in the leg. He was found, unconscious and lying against a tree, and arrested. Witnesses said he had been in an argument on campus before leaving and returning with an assault rifle.

the punishment does not equal the crime

While reading through older posts of local news for NC I saw that this man will serve 60 days for a crime which had the potential to end in the death of law enforcement officers.

I also saw that a Manteo man faces 20 years in prison and an additional 5 years of supervised release after prison for having child porn.

No doubt the perv is a sicko and should have to go through psychological evaluation and treatment while locked up. But 60 days for what should have been a felony charge that could have ended lives is absurd.

OH NO NO NO>....

AK-47 pointed at police and he won't put it down. NO JAIL TIME NEEDED. This is so wrong. All he needed was a wooden box and a hole to put it in. Such injustice!! When will we learn?

You must be kidding? Only 60 days.....

You point an assault rifle at the police. You refuse to stop pointing the weapon at the police and you only get sixy days in jail. Do they not value the life of law enforcement officers?
What do they to people who fire at the police give them bread and water for sixty days?
He should get at least 10 years. He will be back, fully armed, this time with a couple Glocks for backup.

Bob, I bet there was plea bargain involved.

There were several things he should have been charged with. Notice that he pled quilty to misdemeanor charges. No felony charges filed? Anti gun types want more laws but the ones on the books aren't used.

assult rifle

well the media types are at a lose when they have to report on any crime that is commited with a firearm. They are not well versed on laws the Federal Government set to define the differance between and assult weapon and a simi automatic weapon. Full auto weapons are able to be legally owned with the right stamps from the Feds. The full auto or select fire weapons are the only weapons considered to be assult weapons.A simiauto weapon does not meet the standards of the Federal Government to be called an assult weapon.I am glad they stopped him before he hurt or killed someone.

assault rifle?

Was this a selective fire gun? Or is this a "media" definition for a semi-automatic rifle?

Almost as good as the buried lead of, "Portsmouth substitute teacher charged in gun incident". I guess that kidnapping and burglery weren't as important. "Teacher" and "Gun" in the headline were.

PESKY RIFLE?

What difference does it make if its “technically” an assault rifle or not. If someone has it pointed at you the fact that its semi or full auto is meaningless. What term would you prefer they use instead of assault? Maybe noisy?

That's the Pilot for you

Including the headline, the story used "assault rifle" or
"assault weapon" four times in a four-paragraph story. See, it sounds so much SCARIER that way.

He had a rifle, nothing more. A rifle which, incidentally, fires essentially the same round less accurately than a Remington 700 or any other hunting rifle chambered for .308 you'd care to name.

Typical

This is typical of the local media, especially the Pilot and especially this time of year when the General Assembly is in session.
