Man to serve four years in fatal shooting of uncle

VIRGINIA BEACH

A 23-year-old man who admitted he shot and killed his uncle will serve four years in prison.

Selvin Ramon Ortiz-Banegas pleaded guilty in September to voluntary manslaughter. He was sentenced Monday in Circuit Court to 10 years, with six years suspended, said Macie Pridgen, a commonwealth's attorney spokeswoman.

Police found Yurin Alberto Hernandez-Santos, 27, in a car in the 400 block of Lisa Square with a bullet in his chest and a gun on his lap the morning of Sept. 4, 2010, according to a stipulation of facts, which details the prosecution's evidence.

He died at the scene.

Police arrested Ortiz-Banegas six days after he reported the shooting and charged him with second-degree murder. He pleaded to the lesser charge.

An autopsy found Hernandez-Santos had not shot himself, and he had alcohol and cocaine in his system when he died.

Both he and Ortiz-Banegas had primer residue on their hands from firing a gun, according to the stipulation.
