Trial delayed for Chesapeake man accused of shooting missionaries

CHESAPEAKE

The murder trial for James Boughton Jr., the 21-year-old Deep Creek man accused of shooting two Mormon missionaries in January 2006, has been delayed until November 10.

The trial was scheduled to begin today in Chesapeake Circuit Court with jury selection. Broughton’s defense attorney, Andrew Sacks, said Friday that he asked for the continuance after learning of new evidence in the case. Judge Randy Smith granted the motion for a continuance.

Boughton is to stand trial on charges of first-degree murder, malicious wounding and attempted malicious wounding and three firearm charges. Morgan W. Young of Bountiful, Utah, and Joshua Heidbrink of Greeley, Colo., were walking door-to-door on Elkhart Street in the Deep Creek section of Chesapeake when they were shot. Young, 21, was killed.

Boughton is being held in the Chesapeake City Jail pending trial.



Ed. While perhaps annoying, I don't see how someone trying to

save your immortal soul is a hate crime. I grant you though that it is probably annoying. Hate crimes are not limited to just religion as you (probably unintentionally) implied. Hate crimes (also known as bias motivated crimes) occur when a perpetrator targets a victim because of his or her membership in a certain social group, usually defined by race, religion, sexual orientation, disability, ethnicity, nationality, age, gender, gender identity, or political affiliation. These young men COULD very well have been a victim of a hate crime because of there religion,or because they are/were caucasion, or because they stood out as different in the neighborhood. It could also be the two missionaries witnessed some illegal activity, or any of dozens of scenerios. --Finally as to your wondering how the annoyance of having a Christian worry that you are going to hell, compares to murder and attempted murder. I can say with some certianty the Christian's concern for your soul is NOT motivated by hate. Sorry Ed. You are not the victim of a hate crime. For Morgan W. Young and Joshua Heidbrink however, the jury isn't even seated yet, much less still out on this question.

Is this the third or is it the fourth continuance

for this case? Who is picking up the expenses incurred by the out of state witnesse who travel here from Utah, Colorado, and other places not Virginia? I hope the city of Chesapeake, (bet they do not though) and NOT the witnesses themselves; who come out here time and time and yet time again, only to be told; "Go back home, no justice will be served today. And tomorrow is not looking promising either.

This is not a hate crime...

Because he did not shoot them because of their religion, he shot them because they were probably in his way. The crime has to be motivated by the perpetrators bias against the victim's religion in order for it to be a hate crime. Makes me wonder though, the next time a Christian tells me that I need to believe what they do or else I will go to Hell, would this threat be a hate crime because of their bias against non-Christians? This is, after all, extortion if a tithe is involved...

Why isn't this a "hate crime"?

Oh, I guess if somewhat attacks Mulsims or some other "protected class" then it is a "hate crime", but not Chritians or mormans?
