1 A State institution should produce data to its boss. State of VA
2. All scientific data should always be available. National security etc excepted of course.
3. True scientist want their data validated by others. They only can win by doing so. Should errors be found or questions arise, we simply review our data and/or retest.
4. Truth and validated data will stand on its own merit.
5. EDUCATIONAL INSTUTIONS SHOULD BE TEACHING THESE POINTS!
Repressive regimes
ALWAYS start by silencing the intellectuals and we already know how some regard anyone who is intelligent and who question authority in any way. Universities are the bedrock of democratic ideals and compromising their freedoms democracy is in danger.
Yeah, next thing you know...
they will be claiming "the debate is over" and calling those who disagree "deniers." (Al Gore)
From there, they will start boycotting journals who publish articles disagreeing with them, and rigging the peer review process. (Phil jones)
From there, its only a short step to driving those who disagree with them out of faculty positions or eliminating posts, like State Climatologist, if held by an opponent. (Patrick Michaels)

Records
Why not publish the records IF they support the theory - key word here is theory. Show how you arrived at these conclusions by using the scientific approach --- that is how you arrived at this conclusion isn't it -- or is this why you don't want to publish your process ?
State school?
The last I heard it is a state funded run school therefore the state regardless of who is entitled to any infromation it has.
The undergraduate College is
The undergraduate College is still state funded. The Law School, Business School and Medical School decided 10 years ago to stop taking state funds due to excessive regulation. With an endowment of $4.1 billion in 2009 ($5.1 billion in 2008), they may in fact rethink taking any state funds at all.
Michael Mann's research
Michael Mann's climate research used state funds and was primarily accomplished in a state educational institution and therefore, national security withstanding, should be released to the state for review.
If this charade continues, withdrawal of state funds to the university would seem to be the next logical step.

Further the state law cited wasnt even around when the research was funded by the state. Kenny has no legal standing to bring the suite.

McIntyre and McKitrick, of Climate Audit, the original critics of the Mann Hockey Stick, have, from the beginning, posted ALL their code and data where anyone can download and examine and test it.
More recently, statisticians McShane & Wyner, who have demonstrated the precision Mann claims for back-casting temperatures using proxy records is not mathematically possible with the available data, have posted ALL their code and data, where it is available for anyone to inspect.
So, why, if the nefarious agents of Big Carbon can be open and transparent in all they do must our academic saviors operate behind a cloak of secrecy?
