it's simple...

...if the facility has accepted disabled residents or older resident who are likely to assume a disability in the course of their assisted living life, then they are responsible to ensure equal treatment to all their residents. In this case, noncompliance penalties under the rules set forth in the Americans With Disabilities Act and or State licensing regulations should be enforced.

harbor's edge

This is an important story we're facing an age wave on our shores. With boomers turning 65 last year, the amount of seniors that would be affected by certain policies continues to grow.

See NY Times article from 9 Feb - local bent:

heartless policy

What a cruel and heartless policy. Our elders deserve far better than this.

They are not "banned."

There is a process to allow them to dine in the independent dining facility.

And Mrs. Hodges may dine with her husband in his dining room.

I think the tenor of this article paints the administration much more harshly than is warranted.

JMHO.

Harbor's Edge

In response to JMHO's comment that some Harbor's Edge residents are not banned from all dinning rooms. They are not only banned from the main dinning room but, also from the front hall, the library, the movie theater and any in-house entertainment such as "talks " or music recitals. What could be reason for this ? They don't eat in those places. The small dinning rooms on the second and third floors are not able to accomadate family who visit. The tenor of the Virginian Pilot article was much too kind to the H.E. administration. Judge Hodges is not older or sicker than the average H.E. resident but, paralyzed from back surgery and depends on a motorized wheelchair as do many residents.

Harbor's Edge

This seems like a form of elder abuse. Manageent has taken over half a million dollars and then warehoused people. Schools have spent decades mainstreaing chidren. Why should elders be treated differently because fo their conditions? It sounds like management made an ill-advised decision and is stubbornly sticking to its position for reasons of ego. What a heartless and cruel choice! Knowing about this policy, why would anyone chose to go there? I'll guess that it was not explained when they signed the paperwork and paid for admission. Atlantic Shores and Westminister Canterbury should expect a flood of new applicants.
