very simple if a officer pulls you over for the texting as secondary offense. I would say most people would say I was dialing a number. Also when talking about search and seizure of the phone. I dont see where the law would allow for a phone to be taken.

§ 46.2-1079. Radar detectors; demerit points not to be awarded.

Go all the way

Make it a primary offense to not only text while driving, but using a cell phone while driving. As far as GPS goes, if you punch in your driving route before you depart point A, you should not have to touch your GPS until you arrive at point B. Regardless, is you need a GPS every day to show you how to get to the same place you have worked for the last 2 years, you have far more problems than manipulating a GPS while driving. Does narcissistic ring any bells?

Loop hole in this law

The loop hole is that people are allowed to use GPS. Well since a large percentage of people own Blackberry phones (and I-Phones), all they have to do is keep there GPS on while they are texting. If they are pulled over, erase ALL text messages, and bring up your GPS.

Tada! You have avoided a ticket. Just make sure your GPS application really works so you can prove it to the officer.

This is just another "feel-good" law the politicians pass sometimes to keep their miserable jobs. To enforce it would take another 10,000 law enforcement people and the politicians know it. Are they going to give us that many new cops? Yeah, sure......

No time

The police are way too busy to enforce a law such as this!

What did people do before cell phones

I drive on I-64/264 every day and see dozens of people talking and texting on their cell phones. I have seen more than a few close encounters from them. What did these people do before all this technology. People need to pay attention to the road while they are on the highway. If they want to text on the way to work or home every day then either take the bus or support the construction of light rail so that they can let someone else do the driving.

Wrong way

Needs to be a primary offense. By the time the cop pulls the dummy over, they have put the phone down.

Let them stop the jerk as soon as they see it!
